President Bola Tinubu's hurried and unlawful proclamation of a state of emergency in Rivers State has been categorically denounced by the Nigeria Labour Congress (NLC) and the Trade Union Congress of Nigeria (TUC).
The labor unions demanded that the statement be immediately revoked, arguing that it was an excess of presidential power and that it clearly violated Part II, Section 305 of the 1999 Constitution (as amended).
The NLC President Joe Ajaero and his TUC colleague Festus Osifo jointly issued a statement on Wednesday that included this information.
In addition to being illegal, the alleged suspension or dismissal of the State House of Assembly, the Governor, and the Deputy Governor is a clear attack on democracy.
It creates a risky precedent that undermines constitutional governance and jeopardizes subnational governments' independence.
"A democratic society cannot flourish if elected officials are summarily dismissed at the president's discretion. According to the statement, "any reasonable governor and citizen who believes in the rule of law should be deeply concerned about this reckless move."
In accordance with Section 305(6) of the Constitution, which they said lays out precisely the legal procedure for establishing and maintaining a state of emergency, the unions requested President Tinubu to cancel the "unconstitutional declaration."
They added, "The President must display restraint, adhere to constitutional bounds, and behave in a way that fosters public confidence rather than mistrust as the keeper of the nation's executive powers.
"A democratic society cannot flourish if elected officials are summarily dismissed at the president's discretion. According to the statement, "any reasonable governor and citizen who believes in the rule of law should be deeply concerned about this reckless move."
In accordance with Section 305(6) of the Constitution, which they said lays out precisely the legal procedure for establishing and maintaining a state of emergency, the unions requested President Tinubu to cancel the "unconstitutional declaration."

"We cannot afford to make the same mistakes again because Nigeria has already experienced the agonizing effects of political excess.
Beyond the legal and political ramifications, workers and the general public will suffer grave socioeconomic consequences as a result of this unwarranted state of emergency. It will: Create an environment of uncertainty that deters investment and slows economic growth in Rivers State and beyond; Cause job losses, wage cuts, and financial hardship for thousands of workers in the formal and informal sectors; Disrupt economic activities, forcing businesses to close or scale back operations; expose people to security dangers; historically, states of emergency driven by political motivations have a tendency to worsen rather than to alleviate situations.
"We cannot afford to make the same mistakes again because Nigeria has already experienced the agonizing effects of political excess.

We implore Mr. President to refrain from acting in a way that betrays his democratic credentials by emulating authoritarianism from the military past, especially considering his legendary history of political struggle.
